China'S Patent Application Is In The Eyes Of Foreigners
Foreigners, foreign enterprises and other foreign organizations with regular habitation or business offices in China may enjoy national treatment on the protection of patent rights, that is, they have the same right to apply for patents as their own citizens, so as to obtain patent protection. According to the provisions of the patent law, one of the following 3 situations can be applied for patent in China in accordance with the Patent Law:
(1) the bilateral agreements signed by the foreign countries and their respective countries stipulate that each other shall grant the other party a patent protection.
(2) the international treaties to which the foreign country and our country participate together stipulate that each other shall grant the other party a patent protection.
(3) although the foreign country and the country have not signed bilateral agreements and have not joined the international treaties together, the other party stipulates or practices in practice in accordance with the principle of reciprocity to protect the patent rights of our nationals.
